General Terms of Use

At Agzistence, we are committed to fostering a responsible and lawful digital ecosystem. These terms govern your use of Agzistence.com and AgIntel.in (hereafter “the Site”).

1. Legal Compliance and Content Restrictions

  • Users must comply with all applicable local, state, national, and international laws, including those related to copyright, trademarks, and other intellectual property rights.
  • Content or items in violation of any legal provision will be removed without notice.
  • Agzistence reserves the right to enforce additional restrictions at its discretion.

2. Intellectual Property and Disputes

  • Agzistence is not a legal authority or arbitrator for intellectual property claims.
  • We do not verify if users are authorized to sell or list specific items.
  • If a valid legal document (such as a court order or takedown request) is presented, we may remove listings that infringe on intellectual property rights.
  • Users are encouraged to report any infringement issues directly to us for review.

3. Platform Integrity and User Conduct

  • We reserve the right to suspend or terminate accounts, restrict access, or remove content if users violate policies or disrupt the community experience.
  • Unconfirmed or inactive accounts (inactive for 12 months) may be deactivated.
  • You agree not to:
    • Engage in spamming, misleading practices, or unauthorized promotions.
    • Upload viruses or malicious code.
    • Post illegal, offensive, defamatory, or inaccurate content.
    • Copy, distribute, or use content (including trademarks) without permission.
    • Harvest user data (including emails) without consent.
    • Transfer accounts or user IDs without written permission.

4. Content License

By submitting content to Agzistence, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, distribute, and display the content across all media and formats now known or hereafter developed.

5. Platform Usage Eligibility

  • You must be 18 years or older and legally capable of entering into contracts to use the Site.
  • You must not be currently suspended or banned from the platform.

Liability Disclaimer

  • Agzistence acts as an online platform for information exchange and does not guarantee the quality, safety, legality, or delivery of listed products or services.
  • We are not party to actual transactions between buyers and sellers.
  • Agzistence cannot ensure uninterrupted access to the Site.
  • To the extent permitted by law, Agzistence disclaims all implied warranties and is not liable for:
    • Monetary losses
    • Reputational damage
    • Special, incidental, or consequential damages

Liability Limit: If found liable, our maximum liability is the higher of (a) the fees you paid in the past 6 months.

User Indemnity

You agree to indemnify and hold Agzistence harmless against any claims, legal fees, or liabilities arising from your actions, your violation of these terms, or infringement of any third-party rights.

Registered Users

  • Registration requires submission of accurate and complete information.
  • Upon approval, users receive a unique User ID and password.
  • By registering, you consent to inclusion in Agzistence’s buyer/seller database and allow sharing of basic information with other users.
  • Agzistence may suspend or terminate any account without notice if:
    • There is a breach of agreement.
    • User information is false or misleading.
    • User behaviour poses legal or financial risk to others.

User Obligations

Registered users must:

  • Own or have rights to all content submitted.
  • Do not list or promote counterfeit, illegal, obscene, pornographic, or discriminatory materials.
  • Do not use the platform for deceptive schemes or harassment.
  • Do not upload content that disrupts system integrity or security.
  • Do not promote competing services.

1. Commitment to Intellectual Property Rights

Agzistence respects the intellectual property rights of individuals, institutions, and organisations across jurisdictions. We expect our users—including registered members, sellers, and our Council of Experts—to uphold these standards.

Any unauthorised use of patents, trademarks, or copyrighted content will be dealt with in accordance with this policy and relevant legal frameworks.

2. Prohibited and Permitted Use of Intellectual Property

Prohibited Actions

  • Listing or promoting unauthorised products (i.e., those infringing on active patents or trademarks) is strictly prohibited.
  • Offers to sell or procure infringing items may be removed without notice.
  • Users posting repeated violations will face account suspension and/or termination.

Permitted Listings

  • Products protected under a valid patent may only be listed if the user provides an authorisation certificate or legal documentation from the rights holder.
  • Any content referring to an ingredient or product under patent in certain countries shall be considered restricted in those countries.

3. Consequences of Repeated IPR Violations

Users who repeatedly infringe intellectual property rights may face the following actions:

  • Immediate removal of offending listings
  • Suspension or termination of their account
  • Revocation of membership and associated services

4. Infringement Reporting and Remedial Action

Agzistence is not a legal authority or mediator. However, we take IPR concerns seriously and commit to responsible takedown practices.

What We Do

  • Review and remove listings upon valid IPR claims.
  • Notify involved parties in writing of any content takedown and provide opportunity for response.
  • Allow the accused user to submit a counter-notice. If legal action is not taken by the claimant, we may reinstate the listing.
  • Terminate accounts of repeat or malicious offenders.

Important: By submitting an IPR report, you acknowledge responsibility for your claim and agree to indemnify Agzistence from liability related to its removal.

Agzistence’s Role

  • We do not endorse or validate infringement claims.
  • We are not responsible for judging ownership disputes.
  • Takedowns are conducted on a prudential basis, not as confirmation of legal infringement.

5. Reporting an IPR Violation

To report a suspected IPR violation:

Step 1: Draft a detailed report

Include:

  • A written explanation of the infringement
  • Legal documentation (e.g., patent certificate, registration proof, authorization letter)

Step 2: Email us

Step 3: Evaluation and Action

  • We will review your complaint and take appropriate action, including takedown if the claim is substantiated.
  • The alleged infringer will be notified and given your contact information for direct communication and rebuttal.

Step 4: Counter-notice & Reinstatement

If the accused party files a valid counter-notice, we may reinstate the listing, provided that the complainant confirms legal action within a reasonable timeframe.

6. Policy Updates

This policy may be amended from time to time. Updates will be posted on the Site and are effective upon publication. Continued use of the platform implies acceptance of the revised terms.

At Agzistence, we believe in offering a learning experience that is both risk-free and respectful of everyone’s time and effort. If you're not satisfied with a course you’ve purchased, you may request a refund within 30 days, provided the request meets the guidelines outlined below.

1. Our 30-Day Refund Policy

You may request a full refund within 30 days of purchase for any eligible course. This policy is designed to allow learners to explore our content with confidence while also protecting the integrity of our platform and the efforts of our expert instructors.

Refund requests made more than 30 days after the date of purchase will not be accepted, as instructor payments are processed after this period.

2. When Refunds May Be Denied

To ensure fairness and avoid misuse, Agzistence reserves the right to deny refund requests in cases where we detect abuse, including but not limited to:

  • A substantial portion of the course has already been consumed or downloaded
  • Multiple refund requests have been made for the same course
  • A pattern of excessive refund requests by the same user
  • The user account is reported, flagged for misconduct, or suspended for violations of our Terms of Use or Community Guidelines
  • The course was purchased under a subscription plan, unless otherwise required by applicable law

Refund decisions are made at Agzistence’s discretion and will be enforced in accordance with relevant regulations.

3. Credit-Only Refunds (Agzistence Coins)

In some instances where a direct refund isn’t possible (e.g., payment method restrictions or ineligible circumstances), we may issue a refund in the form of Agzistence Coins. These credits can be used to enrol in other courses on the platform.

Refunds issued as Agzistence Coins still follow the 30-day policy for eligibility.

4. How to Request a Refund

  • Your full name
  • Course name
  • Purchase date
  • Reason for the refund
